Fan Content Creation Policy

At Kinetic Games, we are in awe of the affection and enthusiasm shown by fans for our games. We firmly believe that our community is amongst the most passionate and dedicated. We also believe that fan-created works are a wonderful way for our fans to express their creativity and their love for our games.

So here are some guidelines which let you be creative and which also respect and protect our intellectual property rights – the very things that make our game so special. This Policy outlines the guidelines for creating and sharing ‘fan creations’. It aims to protect our intellectual property rights and ensure that our rights are protected and used in the correct way.

Subject to the ‘Creations must not’ section below, you may:

• Create and share artwork, literature, merchandise and memorabilia in connection with our games for personal enjoyment and non-commercial purposes only;
• Share your creations on social media, personal websites and fan forums and communities, provided you credit us and the specific game; and
• Display your creations at fan events, conventions and gatherings and as long as they are not sold or distributed for profit or any commercial purpose.

Please do not sell or distribute your creations for profit or commercial gain without our prior express permission. We are always willing to hear what you’ve got planned, but it does need our approval before you get too involved.

When sharing your creations, you must make it clear that the creation has been personally created by you and is not endorsed by us or any of our licensors.

Creations must not:

• Use our logos, trade marks, brand, material directly from our games or copyrighted material in any way that suggests official endorsement, sponsorship or affiliation. These are all our valuable and protected registered intellectual property rights and we will get grumpy if you use them without our permission!
• Depict, include, imply or promote any offensive, discriminatory, inappropriate or unlawful content or activity;
• Be unlawful or fraudulent or have any unlawful or fraudulent purpose or effect; or
• Misrepresent our games in any way. This includes, but is not limited to, misrepresenting our brand, any graphical depictions (such as in-game character designs), storylines, themes or atmospheric/sound effects of our games.

Now for the legal bit - we will determine, in our sole discretion, whether a creation is in breach of this Policy. We have the right to require you to remove, take down and/or delete any content shared in connection with a creation. Failure to comply with this Policy may result in us taking action including, but not limited to, issuing legal proceedings against you.

If you share fan creations, you give us irrevocable and perpetual permission to reproduce, upload, link to and refer to the creation and any content incorporating the creation you have shared (whether displayed online or otherwise).
